Forever21 is being sued by Gucci after the fashion house accused them of infringing on their famed green-red-green stripe trademark. They initially asked Forever 21 to stop producing items with either the blue-red-blue or green-red-green stripes. The brand didn’t discontinue any designs and instead requested protection against the trademark of a parallel stripe design of alternating bands colored blue-red-blue and green-red-green.

In addition to this, Forever 21 petitioned for the court to permit their use of the colored stripes as well as dismiss Gucci’s trademarks. Unfortunately, Gucci wasn’t having that. They filed two counterclaims on Tuesday; one in which they petitioned for Forever 21’s complaints to be dismissed and the other was for trademark infringement, trademark dilution, and unfair competition.

“Gucci has today taken steps to finally put an end to U.S. mass retailer Forever 21’s blatant exploitation of Gucci’s famous and iconic blue-red-blue and green-red-green stripe webbing trademarks,” Gucci wrote in a statement to Refinery 29.

“Despite Forever 21’s attempt to use its lawsuit to intimidate us into ceasing its trademark enforcement efforts, Gucci is as committed as ever to protecting its long established intellectual property rights, which are at the heart of the brand’s identity, and to ending once and for all, Forever 21’s reprehensible exploitation of its distinctive trademarks and those of other brands who have suffered the same type of piracy, ” it said.

This isn’t the first time that a fashion brand will be suing Forever 21. Earlier this year, April to be precise, Puma dragged Forever 21 to court over singer, Rihanna’a creepers and bow slides which it made in collaboration with Puma and which Forever 21 decided to make replicas of. In the court documents against it,  the documents claim that the creeper, bow slide, and fur slide styles are ‘confusingly similar’ to Forever 21’s products adding that the ‘use of strikingly similar shoes has not gone unnoticed.
